These terms govern your use of the FASTag service offered by CJ Darcl Logistics Ltd., including the website, mobile applications and the issuance, operation and termination of NHAI-certified FASTag stickers.
In this document, "FASTag by cjdarcl" (or "we" / "our") refers to the FASTag distribution and servicing business operated by CJ Darcl Logistics Ltd., its subsidiaries and authorised representatives. "FASTag" refers to the National Electronic Toll Collection (NETC) programme operated by NPCI under the authority of NHAI and the Ministry of Road Transport & Highways. "Customer" refers to any individual or entity who purchases, activates or uses a FASTag through us.
These terms apply to every tag issued, every transaction routed, and every wallet operated through FASTag by cjdarcl.
The service is open to commercial and personal vehicle owners who satisfy each of the following:
FASTag by cjdarcl reserves the right to decline, defer or revoke onboarding without assigning reason, in cases of regulatory non-compliance, blacklisting, or evidence of misuse.
Each NHAI-certified RFID tag is mapped one-to-one to a specific vehicle registration number and chassis number. Tags must be mounted on the inside of the windscreen at the position prescribed by NPCI within seven (7) days of issuance. Tampering with, transferring, or remounting a tag on a different vehicle is strictly prohibited and constitutes a material breach of these terms.
The tag remains the property of the issuing bank. FASTag by cjdarcl acts as a programme manager and is not the issuer of the tag or the operator of the underlying prepaid instrument.
A single wallet may be maintained at customer, fleet or vehicle level. Recharges may be made via NEFT, RTGS, UPI, corporate cards or standing instructions. Auto-debit at toll plazas is triggered by RFID read at the gantry and is final and non-reversible once a successful debit is reflected on the NETC settlement network.
Toll amounts charged at any plaza are determined by NHAI, the concerned concessionaire and applicable state toll regulations. FASTag by cjdarcl does not set, modify or earn margin on the toll tariff itself.
A customer may raise a transaction dispute through the FASTag by cjdarcl portal within thirty (30) days of the disputed transaction date. Disputes raised beyond this window will be considered conclusively accepted by the customer. Disputes are processed within the NETC chargeback framework prescribed by NPCI.
The customer shall, at all times:
Transaction metadata — including plaza ID, timestamp, vehicle number, tag ID, GPS coordinates of the gantry and amount debited — is logged for reconciliation, regulatory reporting and analytics. Our use of this data is governed by the Digital Personal Data Protection Act, 2023 and our Privacy Policy.
The service depends on the availability of NPCI's NETC network, NHAI plaza infrastructure, telecom connectivity and the issuing bank's switch. We do not guarantee uninterrupted service and shall not be liable for transient outages caused by gantry malfunction, RFID misreads, network downtime or any event of force majeure including natural disasters, strikes, government action, riots, pandemics or cyber-incidents.
To the maximum extent permitted by law, our aggregate liability under this service — whether in contract, tort, negligence or otherwise — shall not exceed the total service fees actually paid by the customer in the three (3) months immediately preceding the event giving rise to the claim. In no event shall we be liable for indirect, incidental, special, punitive or consequential damages.
We may suspend or terminate access, with or without notice, in the event of non-payment, breach of these terms, suspected fraud, regulatory direction, or expiry of the underlying agreement. On termination, all active tags shall be blacklisted on the NETC network and residual wallet balance refunded after deduction of applicable charges, in line with NPCI timelines.
These terms are governed by the laws of India. Any dispute shall first be attempted to be resolved through good-faith negotiation. Failing such resolution within thirty (30) days, the dispute shall be referred to arbitration under the Arbitration and Conciliation Act, 1996, by a sole arbitrator. The seat of arbitration shall be Gurugram, Haryana, and the language shall be English.
We may revise these terms from time to time. Material changes will be notified at least fifteen (15) days in advance through the registered email address of the customer and a banner on the app. Continued use after the effective date of revision constitutes acceptance.
